Jevic Transportation Being Sued By Former Employees

Jevic Transportation Inc. is being sued by their former employees according to a press release. Jevic allegedly violated federal labor law this week when the trucking company abruptly terminated approximately 1,200 employees shortly before it sought bankruptcy protection, according to lawyers for workers who sued the company Wednesday in Delaware federal court.

According to the Complaint, the company was required by the federal Worker Adjustment and Retraining Notification (WARN) Act to give at least 60 days advance written notice of the employee terminations and continue paying certain wages, salary, and benefits during the notice period in accordance with federal law.

The workers' lawyers will seek to have the lawsuit certified as a class action that includes all persons who were terminated without cause at Jevic Transportation facilities on or about May 19, 2008. The suit seeks WARN Act-required wages, salary, commissions, bonuses, accrued holiday pay, accrued vacation pay, pension and 401(k) contributions, and other benefits that would have been paid or covered during the notice period, and attorneys' fees and litigation-related costs.

The defendants are Jevic Transportation, Inc., Jevic Holding Corp., Creek Road Properties, LLC, and Sun Capital Partners, Inc.

The case is "Casimir Czyzewski, Jeffrey Oehlers, et al., v. Jevic Transportations, Inc., Jevic Holding Corp., Creek Road Properties, LLC and Sun Capital Partners, Inc.," in U.S. Bankruptcy Court for the District of Delaware; Case No. 08-11006-BLS; Adversary Proceeding No. 08-50662-BLS.

    I have NEVER even received my last paycheck from JEVIC. I was on vacation the week of May 11 - May 17, 2008, and when I contacted JEVIC Monday 'am' (5-19-08), I was advised to call later ??? At about that same time, I received a knock on my front door, where the FedEx person had dropped a letter between my front door, stating that I no longer had a job! Effective May 19, 2008!!!!!!!!!! I have yet to receive my vacation check or any compensation ( 5 personal days, vacation pay for 5-11-08 through 5-17-08, plus one more week vacation due for 2008). I am unable to reach a 'live person' for assistance!! My family needs this resolved 'asap', any help would be appreciated!!

    Same thing happened to me...on vacation, knock on door, no job, no pay. Pension fund marked active by Jevic and cant draw out although no job...something fishy???No benefits same day...

    jevic didnt take care of no one to the comment from the person in markham... funny what goes around comes around.. as bad as people were treated by management when we came to markham as road drivers now bit you guys in the ass a little bit... i was owed vacation personal days told after 11 years i didnt earn my 4 weeks was past my 11years anniversay.. so know what your talking about mr j2.. we alll were put in the street the same day.. i worked till the 23rd and got payed for my time working.. i was out of j9 so they did it to us twice closed our terminal last year and moved the top guys to a mud field no bathrooms no nothing worked out of a pup.. actually the best year i had with jevic.. no asshole terminal managers no crying road drivers.. its sad its now into oct and i havent found a full time job i can trust.. if i sound bitter i am at jevic and some of the arrogant people i worked with.. but i had a job and was out spoken and didnt let anyone dump on me.. i held safe driving awards have a good reputation with a few top good people.. so to all the people that lost there jobs god be with you..
